2. Performance Commitments
While we are committed to delivering exceptional performances, certain factors may be beyond our control, including but not limited to:
- Venue infrastructure and technical arrangements provided by the client or third-party vendors.
- Unforeseen technical failures (e.g., sound, lighting, power outages).
- Environmental or weather conditions that may impact performance.
Daksh The Band shall not be held liable for performance disruptions caused by factors outside our direct control.
3. Third-Party Services
Our services may involve third-party vendors, including but not limited to:
- Event organizers and coordinators.
- Venue operators.
- Travel and accommodation providers.
We are not responsible for any acts, omissions, or failures of these third parties, and any disputes with them must be addressed directly between the client and the respective service provider.
4. Travel, Accommodation & Security for Outstation / International Events
For events requiring travel outside our home city, the following conditions apply:
- All flight, visa, and accommodation arrangements must be provided by the event organizer/client, including 7–8 flights (1 Business Class + 6 or 7 Economy Class) with complete in-flight food & beverages.
- Accommodation: Minimum of 3 rooms with double occupancy and 1 suite room in a 5-star hotel/resort with full facilities.
- Local transfers: Two 6–7 seater fully air-conditioned vehicles (preferably Innova Crysta or XUV 700, in India) from airport to venue and for other necessary movements.
- Security: Minimum of 2 bouncers near the stage and 4 bouncers accompanying the band during performances as per security protocol.
- If the event location is within 200 km and flights are unavailable or no airport exists nearby, road travel arrangements must be made by the client.
5. Limitation of Liability
In no event shall Daksh The Band, its members, or associates be liable for:
- Loss of profits, revenue, or data.
- Indirect, incidental, or consequential damages.
- Any losses arising from force majeure events such as natural disasters, pandemics, or government restrictions.
