These Terms & Conditions (“Terms”) govern all bookings, events, and performances by Daksh The Band (“Band”) and form a legally binding agreement between the Client/Event Organizer (“Client”) and the Band. By confirming a booking, the Client acknowledges that they have read, understood, and agreed to these Terms.
1. Booking & Payment Terms
1.1 Advance Payment
- A minimum of 50% advance of the total agreed amount is required at the time of booking to confirm the date.
- A Balance 50% must be paid at least three (3) days before the event date.
1.2 Full Payment Deadline
- The complete payment as per the Proforma Invoice must be made at least two (2) days before the event.
1.3 Payment Clearance
- If full payment is not cleared before the event, the Band reserves the right not to perform, and no refund shall be provided.
1.4 Payment Methods : Transactions & Billing
- All payments — including Advance, Balance, or Full Payment — must be made strictly through the following authorized methods:
- Bank Account Transfer
- Details will be provided upon booking confirmation.
- Ensure the correct beneficiary name and account number are used.
- Payment Gateways
- Razorpay
- CcAvenue
- Payment Transaction & Medium
- After making any payment, you must share the transaction ID and screenshot payment medium (e.g., bank transfer, Razorpay, or CcAvenue), and date/time of payment to our official email or WhatsApp number for verification.
- Booking will be considered confirmed only after payment verification.
- Note: We do not accept cash or any unlisted payment method.
2. Cancellations & Rescheduling
2.1 Cancellations by Client
- All payments made are non-refundable in the case of cancellations by the Client or cancellations due to any Natural Disaster.
- However, the booking amount can be adjusted towards another event scheduled within ninety (90) days, subject to availability.
2.2 Cancellations by Band
- In the rare case of Band-initiated cancellation due to unforeseen circumstances (e.g., illness, emergency), the full amount received will be refunded or the event rescheduled, based on mutual agreement.
3. Performance Terms
3.1 Performance Duration
- The standard performance duration is 90 minutes and up to maximum 120 minutes (2 hours).
- Overtime is not permitted, except for 1–2 additional songs upon audience demand, at the Band’s discretion.
3.2 Performance Responsibility
- The Band is not liable for any accidents, mishaps, or damages occurring during the event.
- The Client/Event Organizer is fully responsible for providing a safe and secure environment for the performance.
3.3 Technical & Safety Requirements
- The Client must ensure proper stage setup, sound system, and lighting as per technical specifications shared by the Band in advance.
4. Hospitality & Event Requirements
The Client agrees to provide the following:
- Rooms & Refreshments
- Two (2) private rooms with refreshments available for 5–6 hours, from arrival until the final performance.
- The rooms should be suitable for changing and resting (minimum 1 hour rest before the event).
- Water Bottles
- 25–30 sealed water bottles to be available on stage during the performance.
- Dinner Arrangements
- Post-event dinner for the team (preference: vegetarian).
5. Outstation & International Event Requirements
For events outside our home city or country, the following arrangements are required from the event organizer/client:
- Flights & Travel:
- International Events: 7–8 flight tickets – 1 Business Class and 6–7 Economy Class.
- Domestic Events: Similar class arrangement where applicable.
- Tickets must include full meals and beverages.
- If the destination is within 200 km and flights are unavailable or no airport is nearby, the team may travel by road.
- Accommodation:
- Minimum 5-star hotel/resort or equivalent.
- 3 double-occupancy rooms and 1 suite room with full amenities.
- Local Transfers:
- Two 6–7 seater AC cars (Preferred: Innova Crysta or XUV 700 in India).
- Pickup and drop between airport and hotel/venue.
- Security:
- At least 2 bouncers near the stage.
- 4 bouncers with the team during performances for security protocols.
6. Force Majeure
Neither party shall be held liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, pandemics, strikes, or technical failures.
7. Governing Law & Dispute Resolution
This Agreement shall be governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi or Uttar Pradesh as per Band/our corporate company decision.
8. Invoicing, Billing & Corporate Processing
All invoicing, billing, and transaction processing will be done only via our corporate company “True Knock Events”. All payments, billing, and bookings should be made exclusively through True Knock Events (a brand of True Knock Group), our official corporate and booking partner.
9. Liability
We are liable to change terms and conditions at any time for both online and offline bookings, including bookings via our website, without giving any prior notice (online/offline/telephonic/social media/others) to any person, entity, company, NGO, government organization, or firm. This applies to all customers.
We only accept bookings from individuals above 18 years of age. If you are a minor, do not attempt to make a booking.
If, by mistake, we accept a booking from a minor, we will not be liable for any changes, cancellations, payments, or refunds in such cases.
10. Acceptance of Terms
By making a booking, the Client confirms that they have read and agreed to these Terms & Conditions in full.
